Background

This case was an example of how poor planning on a land developer can negatively impact property owners downstream.

In this example, a property owner experienced a flood due to additional flow and runoff from a new property development.

Outcome

After researching the development, I found evidence that the land developer improperly calculated and/or took insufficient steps to capture, divert, and otherwise prevent water runoff that would be previously absorbed or diverted naturally prior to their development of the land. The resulting directed runoff resulted in higher flood stages during a storm and caused significant damages to properties downstream.

Role

Prepared declaration on behalf of the plaintiff.
